New York, N.Y. - A man in New York City, arrested for giving a police officer the finger during a traffic stop, is having his lawsuit brought back.

A New York Federal Appeals Court reinstated the 2006 lawsuit after it had been tossed out.

Police said they stopped the car because they thought the gesture was part of a domestic dispute.

The couple involved is seeking unspecified damages.
